ethical implications or issues noted with this client case
The ethical issue with this client case is the fact that Jeb is having some sort of relationship with a current client outside of work. Another ethical issue would be Jenna discussing this with the secretary and dropping the name of the client to her to get more information. Another ethical issue is Jenna not trying to speak with Jeb first before escalating the matter to a supervisor. Jenna may have misinterpreted something when she was observing their behavior that could have been resolved instead of amplified. I strongly believe there is a “chain” to follow in order to rectify certain concerns, and in this instance, I would have gone to the source to talk to Jeb about what I saw.

I do not believe either Jeb nor Jenna behaved in a manner which is consistent with current standards and principles based on the readings. Page three of our text states that several of the dimensions of an ethical professional include but are not limited to being able to practice in a competent manner wielding the “knowledge, skill, judgment and character” to do so, and to also be able to recognize the power that you hold as an ethical professional as you use it wisely (Welfel, 2005). Jeb did not use his abilities as an ethical professional in a competent manner, but neither did Jenna when she spoke with the secretary about the matter, or when she over-exercised her power by sending Jeb a voicemail that could be interpreted as intimidating in nature and going in front of their supervisor without even trying to mitigate the situation with Jeb. It does not seem to me that either of these individuals comprehend moral sensitivity of being able to identify this kind of scenario as one that would risk serious implications on the welfare of another individual.
what other courses of action would be deemed more ethical practices?
Jeb must recognize that having a relationship with a client outside of work can result in devastating effects on the client should something go wrong, and professionally discourage that behavior to the client by explaining his stance and position in their life. This is generally done in the beginning of the intake session. If Jeb were to ever act in a way that the client deems betraying their trust, the client could hurt themselves, someone else, or even Jeb. It would risk a lasting impact on the client of having trust issues, and make the need for therapy even stronger even though the client may now want to avoid therapy altogether.
Jenna, as a counseling professional, should trust in her communication skills and ability to talk to other as she approaches Jeb about what was witnessed. The discussion does not have to be a confrontation at all. If it turns into a confrontation, she could simply walk away or try and de-escalate the situation. As a colleague, we look out for one another and try to have the best interests of each other in mind in what we do for our clients, for each other, and for ourselves. Either way, if this does not work, that is when I believe she should go to her supervisor. Lastly, I feel like in order for Jenna to really know who Jeb was having dinner with, she must have confided in the secretary what she saw which is unnecessary. That conversation could have been avoided altogether by just striking up a conversation with Jeb about simply being at the same restaurant the other night and gently steering the conversation into helping Jeb avoid repercussion, especially since the client is coming in later in the week.
If the professional fails to act responsibly and his or her misconduct is reported to a disciplinary body, what kind of action do you believe that body should that in this type of case?
If Jeb does not correct his behavior and chooses to have a personal relationship with a client outside of meeting hours, I do feel like the director needs to be notified, and the reprimand the director provided is in step. Jeb’s relationship could expand into something dangerous that could lead to implications of sexual misconduct, and if this issue is not addressed in some way by the powers that be, then the director, the secretary and Jenna could be accessory to any damaging accusation since they were aware of the event and did nothing.
If the professional behaved unethically but the conduct is never reported to any disciplinary body, what action(s) if any, do you believe should be taken to help undo the damage?
Speaking only on Jeb in this instance, I believe he should adhere to his code of ethics and discuss with the client that he has made a mistake, and offer choices to the client. Depending on the code and laws in the area he practices in, he can tell the client that he must keep a professional level relationship with the client only, or he must discharge the client from his care/refer the client to another specialist in order to keep their relationship outside working hours. This of course is a gray area because if the behavior observed at dinner the other night was that of intimate conversation, damage may result on the client.
What should I do as a future clinician/counselor to make sure I maintain the appropriate code of ethics and boundaries where I do not violate these codes?
I should familiarize myself with the code of ethics and the professional and moral boundaries I am to uphold and discuss these with my client at intake. This way, we start on the right foot where our relationship is clearly implicated and leaves little to no room for error. In fact, Ponton and Duba (2009) argue that counseling is an ever-evolving profession, molding and bending itself to the ever-present need for society to thrive and be at peace. What better way to do this than to start with yourself and evolve as a professional first? Sound and resolute ethics are key to the relationship between ethically professional counselors and a society who needs them.
As a future clinician/counselor, what do I believe is the best solution for caring for, serving and advocating for the client?
As a future clinician, I believe the best solution for caring for, serving, and advocating for the client is to thoroughly emphasize an open and safe session for sharing once intake and boundaries have been established, become attuned to my client’s needs, and always uphold the code I am expected to uphold so that I can provide the human service I am expected to provide. To not uphold the code of ethics is to provide a disservice to my client, and that is not a road I am willing to take.
