FERPA & Doll et al. (2011)
Doll et al. (2011) discuss what types of psychological service records can be used to make educational decisions about students, and the different duties psychologists have in order to ensure there is no conflict of interest with FERPA and the APA ethical guidelines. Should you find yourself in the middle of a conflict involving FERPA, which of the psychologists’ duties do you think would be most important to uphold and why?

If I was a psychologist in the middle of a conflict involving FERPA and the APA ethical guidelines, I think that I would consider the APA ethical guidelines more important to uphold. I say this because it makes me think of the BACB ethical guidelines vs FERPA, and although I do currently work in a school funded by the DOE and would fall under someone having to uphold these guidelines, I am first bound by my BCBA responsibilities and ethical guidelines, and take that more seriously as I would not want to lose my license or be under investigation by the board. I know that there are still consequences for FERPA, but it seems as if these are less likely, less frequently reported, or less severe, depending on the type of violation. Especially since it seems as if FERPA is violated all the time (for example all of our student IDs being used publicly) and no one even seems to realize that violations are going on, I feel as if a violation relating to the BACB ethical guidelines, or in this case the APA ethical guidelines, would be more obvious or detrimental to my career. However, I guess it also depends on the scenario and the type of conflict that I find myself in the middle of, but regardless I still think it would make sense to prioritize the ethical guidelines.
