John, a minor child, was born in Germany. John’s father is a German citizen. John’s mother is a U.S. citizen. John’s parents were never married, but lived together in Germany until John was six years old. Shortly after John’s sixth birthday his parents separated. John and his mother moved to Florida. John’s father consented to the move.
The father visited with John on several occasions in Florida. On John’s ninth birthday his father came to Florida to take John to Disney World. Dad never took John to Disney World, but rather took John back to Germany. John’s mother had no idea this was going to happen and did not discover John’s location for eighteen months. John’s mother immediately filed a petition under the Hague convention for John’s return.
John’s father produced a consent to take John to Germany signed by John’s mother. John’s mother denies that she ever signed this consent. John has lived with five different relatives since arriving in Germany. John’s father has alleged that John’s mother’s boyfriend physically abused John in Florida.
